The accusation of plagiarism is something that all hit song writers’ fear. The expensive court case that offers up the double whammy of attacking their creditability and draining their bank balance. It seems that no-one is safe from the litigation over stolen melodies, lyrics and even bass-lines.

Everyone from U2, Coldplay, Johnny Cash and ex-Beatles have had to deal with the damaging issue of a musical lift from an existing song. I will list some of the more famous legal battles that have occurred over the issue of musical originality and the profits behind them.

One of the most famous cases of plagiarism is that of former Beatle George Harrison’s My Sweet Lord. Harrison’s first solo single was a huge success. The song was a number one hit on both sides of the Atlantic in 1971 as well as Germany, Australia and Ireland. The song shot back to number one in the UK in 2002 after Harrison’s death. The song was grounded in Harrison’s new found faith and the a homage to the Hindu God Krishna.

Shortly after its release the similarities between My Sweet Lord and The Chiffon’s He’s so Fine where noticed and a court battle ensued. The U.S. federal court decision in the case, known as Bright Tunes Music v Harrisongs Music, decreed that Harrison was found to have unintentionally copied passages from the song. The legal wrangles went on for ten years with the settlement finally being dealt with in 1981. Harrison ended up $500,000 out of pocket as a result of his unintentional lift.

George Harrison is not the only artist to suffer financially as a result of plagiarism. American ballad superstar Michael Bolton was ordered to pay the sum of $5.4 million in a payout to the Isley Brothers for lifting material from their song Love Is A Wonderful Thing. The Bolton song of the same name was deemed to have been a lift from the Isley Brothers original. The ruling in 2000 resulted in Michael Bolton attempting and failing to purchase the publishing rights to the Isley Brothers song book.

Not all cases reach court. Vanilla Ice’s direct lift from the Queen and David Bowie hit under pressure resulted in an out of court settlement. The worldwide hit from 1991 was based on a sample of the bassline line from the Queen and Bowie record but no attempt was made to license or credit the original composers of the song before the song was released. The result of this action was a massive out of court settlement that stripped Vanilla Ice of the majority of the royalties from the sales of the hit single and album.

Other notable out of court settlements of musical theft include, New Order paying John Denver for lifting parts of Leaving on a Jet Plane for their single Run2. Radiohead had to ad a co-writing credit to their first hit single Creep once the similarity to the Hollies Air That I Breather was noted by the composers of the 1960′s hit.

Some musical lifts go unpunished as the original writers seem to assume that the old adage of imitation being the sincerest form of flattery still holds true. U2′s beautiful days is very close in melody to the A-Ha hit the Sun Always Shine’s on TV and the recent chart hit by La Roux Quicksand can be seen as a re-write of Prince’s When Dove Cry.

In this post modern world we live in with sampling of old tunes part and parcel of musical culture there are bound to be more and more cases of plagiarism reaching the courts. It will be interesting to see who is the next major artist accused of stealing a hook will be?

What’s the difference between bass guitar chords and guitar chords? Is there one?

I want to get my boyfriend a Beatles chord book for Christmas, but I am not musically inclined whatsoever. Is there a difference between a “normal” guitar chord and a bass guitar chord? I really like this one right now: http://www.amazon.com/Beatles-Complete-Chord-Songbook-Guitar/dp/0634022296/ref=sr_1_7?s=books&ie=UTF8&qid=1290291264&sr=1-7
but I know it says guitar… and I’m not sure if it works with a bass too.
Please help :)
thanks

Joni Mitchell would go on from this ’71 recording to make more popular, more ambitious, and more challenging albums, but she’s never made a better one. Working with minimal accompaniment (Stephen Stills and James Taylor are two of the four sidemen), the Canadian thrush summoned an involving song cycle of romance found and lost. Though Blue is an uncommonly intimate representation, it’s also astoni…
