Am I allowed to do this or will I get arrested?

For years, during the weeks before christmas, my parents like to set up two reindeers on the front lawn. For the past three years, there were incidents where we came home from wherever and the reindeers were moved into a sexual position. Doggystyle to be exact. I know there are two teenage boys who live in my neighborhood and I just know its them. This year I’m going to catch them in the act. My dad has a gun, a 9mm. I’m 18. Can I use the gun just to scare them. I know I can’t shoot at them unless they come at me but can I just hold it in my hand to intimidate them?

In my state if you displayed a firearm with the intent to scare them it would be called menacing. Menacing is a felony.

If you fired a few warning shots into the ground or air it would be menacing and reckless endangerment both of which are felonies.

As a convicted felon you would no longer be able to possess firearms.

Deadly weapons are only to be used if you are in fear of losing your life or suffering grave bodily injury. Try not to put yourself in a situation where either would occur. If you intentionally put yourself in danger to allow you to use deadly force you would lose in court.

I don’t know about your community – or if the police respond to non-violent crimes. It probably depends on the budget.

Maybe try and catch them in the act with a camera?
